TERMS OF LEASE In addition to the terms below, and the operation guidelines on each rented item, the Lessee (customer) agrees to supervise the operation of any rented item and further agrees that if the item is damaged that he/she will reimburse Prime Tent And Furniture Rental for the full price to fix the damage and/or the full replacement value of the rented item. Before signing this contract, Lessee agrees that he/she has read the entire contract, has agreed to all terms and conditions herein, and has had all questions he/she may have answered to the Lessee’s full satisfaction and understanding. Delivery/Payments: To address specified by Lessee. Lessee grants Prime Tent And Furniture Rental and its employees/contractors, the right to enter said property for the delivery and return of the rented equipment at approximate times. All payments must be made at time of delivery. No refunds will be made after the equipment has been delivered. Please make checks payable to: Prime Tent Rental 162 Industrial Blvd Unit 1b Hanson, MA 02341 _______________ Lessee Initial 1) In order to secure the rental items, a non-refundable deposit of 50% is required. The remaining balance is to be paid on or before the day of installation. If you need to cancel your rental items, your deposit can be applied as a raincheck valid for up to one year after the event date. 2) We accept cash, checks, and credit cards. If paying with cash, please note that our drivers don´t carry change. Payment is due at time of set up. 3) Please call our office if you have stairs or a tiered backyard, so we can discuss setup options. 4) All furniture MUST be stacked and kept under the tent or garage to keep it dry. 5) We will call you the week before your event with a setup day/time. Set up time is subject to change depending on schedule and route changes. 6) The customer is responsible for contacting Dig Safe and completing any necessary permit applications. Please note that there will be additional charges incurred if we are requested to obtain a permit on your behalf and schedule Dig Safe services. 7) In the event that additional labor is necessary for the installation or removal of equipment for your specific event, such as weekend hours or unexpected terrain conditions, these additional labor hours will be included in your final bill. 8) This quote includes set up of tent, tent accessories and flooring. Funiture set up is not included in the price unless otherwise stated. 9) Our drop-off days are Wednesdays, Thursdays, and Fridays, while pick-ups typically happen on Mondays and Tuesdays unless specified otherwise. However, please note that exact dates and times might be subject to adjustments. If you require a precise day or time for drop-off or pick-up, there may be an extra charge. Feel free to share any specific instructions you have regarding scheduling. Additional Terms of Lease: Cancellation Policy: To secure your booking, a 50% non-refundable deposit is required. In the event of a cancellation, this deposit serves to mitigate any incurred costs and secure our services for your intended date. Should you need to cancel your booking, the non-refundable deposit can be applied towards rescheduling for a rain date within one year from the originally scheduled booking date. This flexibility allows you to retain the value of your deposit for a future event, accommodating unforeseen circumstances while ensuring the continuity of our service commitment to you. Please note that any changes to the booking date are subject to availability and must be communicated to us in a timely manner. We appreciate your understanding of our cancellation policy and commitment to providing exceptional service for your event needs. Weather and Unforeseen Circumstances: Prime tent rental accepts no liability for unfavorable conditions, disruptions in electrical service, or adverse weather that may arise. Charges or fees will not be reimbursed due to these circumstances. In the event of no fault on the part of Prime Tent Rental, additional fees may apply, encompassing, but not limited to, labor, delivery, and accommodation costs. Equipment Use and Liability: The Lessee expressly agrees that the leased equipment is for their exclusive use and shall not be loaned, sublet, mortgaged, or disposed of in any manner. The Lessee bears full liability for any loss of equipment due to fire, theft, or any other cause. Hold Harmless Provisions: The Lessee undertakes to indemnify and hold Prime tent rental harmless from any and all claims, actions, suits, proceedings, costs, expenses, fees, damages, and liabilities arising from the use of the leased equipment. This includes injuries, damages, or fatalities to persons or property. The Lessee releases Prime tent rental from any injuries or damages incurred during the use of the equipment. Prime tent rental is not liable for injuries due to inappropriate use, acts of God, nature, or other conditions beyond its control. The Lessee further indemnifies Prime tent rental from any loss, damage, theft, or destruction of the equipment during the lease term. Disclaimer of Warranties: Prime tent rental explicitly disclaims any warranty, either express or implied, regarding the condition or performance of the leased equipment. The Lessee agrees to immediately cease use and promptly notify Prime tent rental should any equipment exhibit signs of defects or improper working conditions. The Lessee utilizes the equipment at their own risk. Breach/Indemnity/Arbitration: In the event of a breach, the Lessee commits to paying for consequential damages, indemnifying Prime tent rental for costs incurred in enforcing the lease terms, and defending against any claims arising from the operation of the equipment. Prime tent rental retains the right to exercise remedies, including the termination of the agreement, reentry and retrieval of equipment, declaring outstanding rent due, and pursuing legal proceedings. Any conflict shall be resolved according to Prime tent rental state laws, thus avoiding resorting to a lawsuit. Contract Acknowledgment: By affixing my signature to this contract, I, as the Lessee, solemnly acknowledge that I have diligently read and comprehended this contract and any accompanying addendum(s). I have been thoroughly instructed by [Setting:Company_Name] personnel as a trained operator for the equipment, and all inquiries have been satisfactorily addressed. I acknowledge and accept that I am exclusively responsible for adhering to the terms delineated in this rental contract agreement and any accompanying addendum(s).
